  1. Terms and Conditions

    Since we all know the importance of a successful vacation nowadays, we have tried to
    create all the necessary conditions for this. This also includes clear legal rules which, unfortunately, are part of it.

    We hereby announce our rental conditions for our vacation apartments in Eltville, Burgstr. 3 known.
    The rental conditions also represent the procedure of booking and payment.
    With your booking you accept these rental conditions.

  2. Conclusion of contract and payment

    The accommodation contract is concluded when the provider confirms the booking request of the guest
    by telephone or in writing by mail, e-mail and/or fax and thus accepts the booking (application acceptance).

    With the booking confirmation you may receive a request to pay a deposit.
    The deposit must be received on our account within 21 days after receiving the booking confirmation.
    If the deposit is not received by us within the specified period, we interpret the non-payment as a withdrawal from the contract by the tenant.

    Payment of the balance/total amount will be made in cash on the day of arrival.
    The guest accommodation contract obligates guest and landlord to comply and comes only between landlord and guest, as well as the persons accompanying him and registered persons.

    The guest is obliged to provide truthful information about the number of persons occupying the vacation apartment.
    The apartment is available for a maximum of the number of people specified in the booking confirmation.
    The occupancy with a number of persons exceeding this number requires the prior written consent of the provider.
    In this case, the price for the transfer of the vacation apartment increases to the price generally charged by the provider in case of corresponding occupancy.

  3. Cancellation by the tenant:

    The tenant may withdraw from the rental agreement before the start of the rental period by submitting a written declaration to the landlord.
    If the tenant withdraws from the rental agreement, he shall pay lump-sum compensation in the following amount:

    • for cancellation up to 30 days before the start of the rental period 50% of the rental price
    • for cancellation up to 14 days before the start of the rental period 80% of the rental price
    • for cancellation up to 7 days before the start of the rental period 90% of the rental price

    The time of receipt of the notice of withdrawal by the lessor is decisive. We recommend travel cancellation insurance.

  4. Arrival and departure:

    In order to prepare the apartments for the next guests, the apartment must be vacated by 10:00 am.
    Arrival is possible from 15.00.
    We are happy to allow a later departure after consultation and availability.

  5. Early departure:

    In the event of early departure, there is no right to a refund of the rental price.

  6. Booking information:

    For a booking we need

    • Your first name, last name,
    • the names of rental travelers,
    • as well as your full address
    • telephone number and (if available)
    • email address.

  7. Handover when leaving the apartment:

    We would like to ask you to leave the vacation apartment in a tidy condition (broom clean).
    This includes washing dishes, separating and disposing of your waste in the designated receptacles.

  8. Liability:

    The tenant and his accompanying persons are fully liable for any damage caused to the inventory, the vacation apartment or the house.
    Any damage should be reported to us immediately and can usually be settled through your private liability insurance.

  9. House law:

    Under certain circumstances (occurs very rarely, e.g. fuse box in the apartment) it may be necessary for the landlord to enter the vacation home without the knowledge of the guest.
    Please give us here for emergency a cell phone number where we can reach you during their stay with us.

  10. Pets are not allowed:

    Pets are not allowed in the apartments, in the house, or on the grounds.

  11. Smoking is not allowed in the building:

    Smoking in the apartment and in the house is not allowed. Outdoors you have the opportunity to do so.

  12. Termination by the landlord:

    The lessor may terminate the contractual relationship before or after the start of the rental period without notice if the lessee, despite prior request, fails to make the agreed payments (down payment or final payment) in due time or otherwise behaves in breach of the contract to such an extent that the lessor cannot reasonably be expected to continue the contractual relationship.
    The guest must then leave the apartment immediately.
    In such a case, the landlord may demand compensation from the tenant for expenses incurred up to the termination and for lost profit.
    A claim for refund of the rental price does not exist in this case.

  13. Price reduction:

    In the event of a short-term failure of furnishings, public supply or force majeure, there is no entitlement to a price reduction. Defects in the apartment must be reported immediately to the landlord.
    The guest grants the landlord a period of 24 hours to remedy the defects, later complaints will not be accepted.
    Price reductions due to defects are based on the usual practice in the accommodation industry and are subject to consultation with the landlord.

  14. Consumables:

    Our apartments are equipped with a basic set of toilet paper, dish soap and cloths.
    Additional demand is at the expense of the tenant.

  15. Severability clause:

    If one of the aforementioned rental conditions is legally invalid, it will be replaced by a corresponding closest regulation.
    The other rental conditions remain unaffected and still valid.

  16. Application Process:

    In the course of handling application procedures in our company, we work together with the application platform of the service provider Workwise GmbH, imprint https://www.workwise.io/impressum. Personnel placement on behalf of job seekers or employers is not order processing, but the use of an external specialist service by an independently responsible person (LDA-Bavaria, FAQ list from 20.07.2018).   17. Place of jurisdiction:

    The place of jurisdiction for all disputes arising from these General Terms and Conditions or the rental contracts is the competent local court Eltville.
    First, however, in any case, an attempt should be made to settle disputes out of court.
